This document sets out the terms and conditions for using the website www.giftart-candle.ro and the conditions under which products offered by GIFT ART CANDLE SRL are sold.

By accessing and using the website, as well as by placing an order, the user/client confirms that they have read, understood, and accept these Terms and Conditions.

We recommend carefully reading this document before using the website and placing an order.

In this document, GIFT ART CANDLE SRL may hereinafter be referred to as "the Company," "the Seller," or "we."

The person accessing the website or purchasing products will be referred to as "Client," "Buyer," or "you."

GIFT ART CANDLE SRL sells scented candles and related products online, according to the offer available on the website.

The information presented on the website, including product descriptions, photos, dimensions, weights, scents, and prices, is provided for informational and commercial purposes.

We strive to ensure that the information on the website is accurate and up-to-date.

Product photos are for guidance only. Minor differences may exist between the appearance of the product presented in photos and the product received, including color differences, depending on lighting, the device screen used, or the production process.

3. Website access

Access to the website is permitted to any person, in compliance with applicable law and these Terms and Conditions.

It is forbidden to use the website for:

  • carrying out illegal activities;

  • transmitting false or fraudulent information;

  • affecting website operation;

4. Placing orders

Orders can be placed through the website, according to the procedure available at the time of purchase.

To place an order, the client may be asked for the following information:

  • delivery address;

  • phone number;

  • email address;

  • billing information;

  • other information necessary for order processing and delivery.

By placing an order, the client declares that the information provided is correct, complete, and up-to-date.

If incorrect or incomplete data is provided, preventing order delivery, responsibility for any delays lies with the client to the extent that these are caused by the information provided.

5. Formation of the contract

Placing an order by the client represents an offer to purchase the selected products.

After submitting the order, the client may receive an automatic email confirmation.

Automatic confirmation of order receipt does not necessarily mean acceptance of the order by the Seller.

The sales contract is considered concluded when the order is accepted by GIFT ART CANDLE SRL, in accordance with applicable law.

If a product is no longer available, there is an obvious pricing error, or there are other objective reasons preventing the execution of the order, we will inform the client and, if applicable, refund any amount paid.

6. Product prices

All prices displayed on the website are expressed in lei (RON).

The displayed prices include VAT, if GIFT ART CANDLE SRL is registered for VAT purposes and applicable law so requires.

The product price is that displayed on the website at the time the order is placed.

Shipping costs are displayed separately, before order finalization, if they are not included in the price or offered free of charge.

We reserve the right to change product prices. Changes do not affect orders already accepted.

In the event of an obvious pricing or display error, we reserve the right to inform the client and correct the error, while respecting their rights under applicable law.

7. Payment methods

Depending on the options available on the website, orders can be paid for by:

  • online card payment;

  • cash on delivery;

  • other payment methods displayed on the website.

For online payments, card data is processed through the payment service provider used by GIFT ART CANDLE SRL.

GIFT ART CANDLE SRL does not directly request or store full bank card details if they are processed exclusively by the payment service provider.

If an online payment is refused or the transaction fails, the order may not be processed until a valid payment method is confirmed.

8. Product delivery

Products are delivered via courier services available on the website.

Delivery costs and conditions are displayed before order finalization.

The estimated delivery time is communicated to the client during the order process or in the order confirmation.

Delivery times may be affected by factors beyond GIFT ART CANDLE SRL's control, such as:

  • courier company delays;

  • weather conditions;

  • busy periods;

  • public holidays;

  • force majeure situations;

  • incorrect information provided by the client.

In case of significant delays, we will make reasonable efforts to inform the client.

9. Package verification

The client is encouraged to check the condition of the packaging and the product upon receipt.

If the product shows visible damage due to transport, the client is recommended to document the situation with photos and contact us as soon as possible.

Complaints regarding products damaged during transport will be analyzed individually, taking into account the circumstances of the case and applicable law.

The absence of an immediate complaint does not waive the consumer's legal rights.

10. Right of withdrawal and product returns

In the case of distance contracts, consumers benefit, under applicable law, from the right to withdraw from the contract within 14 days, without being obliged to justify their decision.

The 14-day period begins, in the case of product sales, from the date on which the consumer or a person indicated by them, other than the carrier, acquires physical possession of the products.

To exercise the right of withdrawal, the client must send us an unequivocal statement informing us of their decision to withdraw from the contract.

The client may use any unequivocal form of communication to exercise the right of withdrawal.

11. Exceptions to the right of withdrawal

There are situations where the right of withdrawal does not apply, under applicable law.

In particular, the right of withdrawal may be excluded for products manufactured according to the consumer's specifications or clearly personalized, as well as for other categories of products exempted by law.

In the case of personalized products or those made at the client's request, information regarding any exceptions to the right of withdrawal will be communicated appropriately before order finalization.

12. Product returns

In the event of exercising the right of withdrawal, the client must return the products without undue delay and, in any case, within no more than 14 days from the date on which they informed us of their decision to withdraw, unless GIFT ART CANDLE SRL offers to collect the products.

Products must be returned in a condition that allows their verification, taking into account the nature of the product and the legal limits regarding consumer liability for depreciation of the products.

The direct costs of returning the products are borne by the client, unless GIFT ART CANDLE SRL agrees to bear them or applicable law provides otherwise.

13. Refund of amounts

In the event of valid exercise of the right of withdrawal, GIFT ART CANDLE SRL will refund the amounts paid by the client, including, where applicable, standard delivery costs.

The refund will be made without undue delay and, under the law, no later than 14 days from the date on which we were informed of the decision to withdraw.

We may withhold the refund until we receive the returned products or until the client provides proof of sending the products, whichever is earlier.

The refund is made using the same payment method used for the initial transaction, unless the client has expressly agreed to another method.

14. Defective or non-compliant products

The products sold benefit from legal rights regarding product conformity, under applicable law.

The situation will be remedied according to consumer rights and applicable law.

15. Candle use and burning

Scented candles must be used in compliance with the safety instructions and recommendations provided with the product.

For safe use:

  • do not leave a burning candle unattended;

  • keep the candle away from children and pets;

  • keep the candle away from flammable objects;

  • do not move the candle while the wax is liquid or the product is hot;

  • use the candle on a stable, heat-resistant surface;

  • do not use the candle if the container is damaged;

  • follow the specific instructions provided for the product.

The client is responsible for using the product according to safety instructions.

16. Intellectual property

The entire content of the website, including, without limitation:

  • the logo;

  • the name and visual identity elements;

  • photos;

  • texts;

  • product descriptions;

  • graphics;

  • design elements;

  • video materials;

  • website structure;

may be protected by copyright, trademark, and intellectual property law.

It is forbidden to copy, reproduce, distribute, modify, or commercially use the content of the website without the prior written consent of the rights holder, except for situations permitted by law.

17. Reviews and user-submitted content

If the website allows the submission of reviews, photos, or other materials by users, they are responsible for the content submitted.

These Terms and Conditions are governed by Romanian law.

No provision of these Terms and Conditions limits the rights that the consumer mandatorily benefits from according to applicable law.
